Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the Notify mobile application (the "App") operated by Notify ("us", "we", or "our").
Your access to and use of the App is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the App.
By accessing or using the App you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the App.
When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our App.
You are responsible for safeguarding the password that you use to access the App and for any activities or actions under your password, whether your password is with our App or a third-party service.
Our App allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material ("Content"). You are responsible for the Content that you post to the App, including its legality, reliability, and appropriateness.
The App and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of Notify and its licensors. The App is protected by copyright, trademark, and other laws of both the United States and foreign countries.
The App offers an auto-renewing subscription, "Notify Plus," which unlocks unlimited circles, larger circles, unlimited saved places, and priority full-screen alerts (with additional features marked as "coming soon" unlocked as they become available). Notify Plus is offered in the following subscription periods, at the price displayed in the App and on the App Store at the time of purchase:
Payment will be charged to your Apple ID account (or Google Play account, on Android) at confirmation of purchase. Subscriptions automatically renew for the same period unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period, at the price of the renewal period. You can manage your subscriptions and turn off auto-renewal at any time by going to your Account Settings in the App Store (or Google Play Store) after purchase. Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription, where applicable. No refund will be issued for the unused portion of any subscription term, except as required by applicable law or the policies of the App Store or Google Play Store through which you subscribed.
Our App may contain links to third-party web sites or services that are not owned or controlled by Notify. Notify has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services.
We may terminate or suspend your account immediately, without prior notice or liability, if you breach these Terms, including without limitation for fraudulent, abusive, or illegal activity, or for non-payment of an active subscription. Upon termination, your right to use the App will immediately cease, and any pending subscription must still be cancelled separately through the App Store or Google Play Store to stop future billing.
In no event shall Notify, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the App; (ii) any conduct or content of any third party on the App; (iii) any content obtained from the App; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
If you downloaded the App from the Apple App Store, these Terms are between you and Notify only, not with Apple Inc. ("Apple"), and Apple is not responsible for the App or its content. Apple has no obligation to furnish any maintenance or support services for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you; to the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App. Apple is a third-party beneficiary of these Terms and, upon your acceptance, will have the right to enforce these Terms against you. The same applies to Google LLC if you downloaded the App from the Google Play Store.
